The CEO report indicates at page 19 that this April, there were just three public record requests and all were "closed." But I know for a fact that at least one was closed when BCHD asserted that its property was exempt from CA law for properties acquired by eminent domain, which is clearly the case for the BCHD property.
BCHD claims it may withhold the reason for this exemption, asserting attorney-client privilege, so BCHD has not at all responded to the question. As a champion of transparency and given that BCHD is legally free to waive any privileges associated with the attorney client privilege on this issue, can BCHD now state a reason why it believes it is exempt from CCP 1245.245 and related state rules for public properties?
Where are the Resolutions of Necessity for new uses of the property to be found? Also, can BCHD assert that all future uses of the HLC are, indeed, public uses, as required by law?
