StopBCHD objects to any use of District Taxpayer funding subsidies or asset use for non-residents of the District without fully compensatory charges to the non-residents. BCHD is embarking on an 80% to 95% non-resident services program with 80% non-resident assisted living tenants (per MDS Table 3-3), 91% non-resident allcove service area (per BCHD agreement to provide allcove to SPA8) and 95% non-resident enrollees in PACE per National PACE Association data. Voters approved services to "residents who reside within the District", and the District testified to the Superior Court during the "taking" of the Prospect land that it was needed for the "residents who reside within the District." Had the District correctly stated it was "taking" the land for 80% to 95% non-resident use, it would have been denied the condemnation taking by the Courts.
